Who Can Get an Instruction Permit

The Knowledge Test

If You Don't Pass

If you fail the knowledge test, you must wait until the next business day before retaking it. There is no limit on the total number of attempts.

After You Pass

When you pass the knowledge test, the DMV will issue your instruction permit before you leave. Your permit is valid for 1 year from the date of issue. You can begin supervised driving immediately.

Supervision requirement: While driving with an instruction permit, you must have a licensed driver who is at least 18 years old — a parent, legal guardian, or other responsible adult approved by your parent — seated beside you in the front passenger seat at all times.

Begin logging your supervised driving hours immediately. You need to hold the permit for at least 6 months and complete 50 hours of supervised driving (including 10 at night) before you can apply for a Minor's Restricted License.

Instruction Permit Rules

Supervision required: A licensed driver at least 18 years old (parent, guardian, or approved adult) must be beside you in the front passenger seat at all times.

No solo driving under any circumstances.

No handheld phone use while driving — prohibited for drivers under 18.

Seatbelts required for all occupants at all times.

South Dakota's GDL Program

South Dakota's Graduated Driver Licensing (GDL) program has three stages for drivers under 18:

1. Instruction Permit (14+)

Supervised driving with a licensed adult (18+) at all times. Hold for 6 months. Complete 50 hours of supervised driving, including 10 at night. Pass the knowledge test.

2. Minor's Restricted License (14.5 with driver ed / 15 without)

Drive independently with restrictions: 10pm–6am curfew, limited passengers, and no handheld phone use. Must pass the road skills test.

3. Full License (16+)

GDL restrictions lift at 16. Full driving privileges with no curfew or passenger restrictions.

Getting Your Minor's Restricted License

After completing the instruction permit phase, you can apply for a Minor's Restricted License. With approved driver education, you can advance at age 14.5. Without driver education, you must wait until age 15.

Requirements:

Be at least 14 years 6 months (with driver ed) or 15 (without)

Hold instruction permit for at least 6 months

Complete 50 hours of supervised driving, including 10 at night

Pass the road skills (behind-the-wheel) test

Parent or guardian must certify the supervised driving log

Driver education must be an approved in-person program — online programs do not qualify for the early advancement benefit.

Minor's Restricted License Rules

Nighttime curfew

No driving between 10 PM and 6 AM unless accompanied by a licensed adult, or traveling to/from work, school, or an emergency.

Passenger restriction

For the first 6 months: no non-family passengers under 18 may ride in the vehicle without a licensed adult present. After 6 months, no more than 1 non-family passenger under 18.

Cell phone restriction

No handheld phone use while driving for drivers under 18 — calls, texts, or any other handheld use prohibited.

These restrictions remain in place until you turn 16 and advance to a full license. Violations can result in license suspension or extension of the restricted period.

Getting Your Full License (16+)

At age 16, Minor's Restricted License holders can apply for a full driver's license. All GDL restrictions — the curfew, the passenger restriction, and the cell phone restriction as a GDL rule — are lifted at this point.

To advance, you must pass any remaining requirements in effect at the time of application. Check the SD DPS website for the current process.

Adults 18+ applying for their first license: No GDL process required. After passing the knowledge test and road skills test, a full license is issued directly. Driver education is not required.

The South Dakota Driver's Manual
