Topic 01

Right-of-Way & Intersections

Exam Difficulty:Medium

Understanding who has the right-of-way is one of the most heavily tested areas on the Indiana DMV exam. Most failures occur here.

Must-Know IN Tip: Mountain Road Yield Rule

When two vehicles meet on a steep single-lane mountain road where they cannot pass, the vehicle facing downhill must yield by backing up until the vehicle going uphill can pass safely.

Core Rules & Tested Concepts

  • At intersections without signs, yield to the vehicle on your right if it arrives at the same time.
  • At T-intersections, vehicles on the terminating road must yield to vehicles on the through road.
  • When making a left turn, you must yield to oncoming vehicles close enough to be a hazard.

Frequently Asked Questions

Your Questions Answered

Quick answers to the most common questions about the Indiana BMV test

How is the Indiana BMV permit test structured, and what is the passing score?
The Indiana Bureau of Motor Vehicles (BMV) knowledge exam consists of 50 multiple-choice questions based directly on the Indiana Driver’s Manual, divided into two sections: 16 road signs and 34 road rules. You must pass both sections with an overall passing score of at least 80% (42 out of 50 correct). The test is taken electronically on touchscreen terminals at BMV branch offices.
What is the minimum age to get an Indiana learner’s permit?
In Indiana, the minimum permit age depends on driver education:
  • Enrolled in Driver Education: You can obtain a learner’s permit at 15 years old by presenting a Certificate of Driver Education (CDE) form from an approved driving school.
  • Without Driver Education: You must be at least 16 years old and pass the BMV knowledge exam.
All applicants must also pass a vision screening (minimum 20/40 acuity) and provide proof of identity, Social Security number, and Indiana residency.
Who is legally qualified to supervise a permit driver in Indiana?
Under Indiana Code (IC 9-24-7-4), an Indiana learner’s permit holder may only drive when accompanied in the front passenger seat by: 1) a licensed driving instructor, 2) a licensed parent, legal guardian, or spouse who is at least 21 years of age, or 3) any other licensed family member who is at least 25 years of age.
How many supervised driving hours are required for an Indiana teen?
Indiana requires teen drivers to log at least 50 hours of supervised driving practice, with at least 10 hours completed at night. Practice hours must be documented on the official Indiana BMV Log of Supervised Driving (State Form 54706) and signed under penalty of perjury by the licensed supervisor prior to taking the driving skills test.
How long must you hold an Indiana learner's permit before getting a license?
Indiana law requires all permit holders under age 18 to hold their learner's permit for a minimum of 180 days (6 months) before taking the driving road exam. Furthermore, applicants must be at least 16 years and 90 days old (if they completed an approved driver ed course) or 16 years and 270 days old (without driver ed) to receive a probationary driver's license.
What curfew and passenger restrictions apply to Indiana probationary drivers?
Indiana probationary license holders under age 21 must obey strict state restrictions:
  • Passenger Restrictions: For the first 180 days, no passengers under age 21 are allowed unless accompanied by a licensed parent, guardian, or adult age 25+ (with an exception for siblings).
  • Night Curfew: Prohibited from driving between 10:00 p.m. and 5:00 a.m. Sunday–Thursday, and between 11:00 p.m. and 5:00 a.m. Friday–Saturday for the first 180 days (except for work, school activities, or religious worship).
  • Cell Phone Ban: Drivers under 21 are strictly prohibited from using any handheld or hands-free telecommunications device while driving.
What are the default statutory speed limits in Indiana when unposted?
Unless posted otherwise, Indiana statutory speed limits under IC 9-21-5-2 are:
  • Urban Residential & Business Districts: 30 mph.
  • School Zones: 20 mph when children are present or beacons are flashing.
  • Unposted Rural County Roads: 50 mph.
  • State Highways (Non-Interstate): 55 mph.
  • Rural Interstate Highways: 70 mph for passenger cars (65 mph for heavy commercial trucks).
What are the legal parking distance rules in Indiana?
The Indiana BMV Driver Manual mandates the following parking clearances:
  • Within 15 feet of a fire hydrant.
  • Within 20 feet of a crosswalk at an intersection.
  • Within 30 feet of a stop sign, yield sign, or flashing traffic signal.
  • Within 50 feet of the nearest rail of a railroad crossing.
  • When parallel parked, wheels must be within 12 inches of the curb.
When must Indiana drivers stop for a school bus with flashing red lights?
In Indiana, motorists must stop when a school bus extends its stop arm and flashes red lights:
  • Two-Lane or Undivided Multi-Lane Roads: Traffic traveling in both directions must come to a complete stop.
  • Divided Highways with a Physical Barrier or Unpaved Median: Only traffic traveling in the same direction as the bus must stop; oncoming traffic on the opposite side of a grassy or concrete median may proceed.
What is OWI in Indiana, and what are the legal BAC limits and implied consent laws?
Indiana uses the term Operating While Intoxicated (OWI). Legal Blood Alcohol Concentration (BAC) limits are: 0.08% for drivers 21+, 0.02% (Zero Tolerance) for drivers under 21, and 0.04% for commercial CDL drivers. Under Indiana's Implied Consent Law, refusal to submit to a certified chemical breath, blood, or urine test results in an automatic 1-year license suspension (2 years for repeat offenders).
