Topic 01

Right-of-Way & Intersections

Exam Difficulty:Medium

Understanding who has the right-of-way is one of the most heavily tested areas on the Oregon DMV exam. Most failures occur here.

Must-Know OR Tip: Mountain Road Yield Rule

When two vehicles meet on a steep single-lane mountain road where they cannot pass, the vehicle facing downhill must yield by backing up until the vehicle going uphill can pass safely.

Core Rules & Tested Concepts

  • At intersections without signs, yield to the vehicle on your right if it arrives at the same time.
  • At T-intersections, vehicles on the terminating road must yield to vehicles on the through road.
  • When making a left turn, you must yield to oncoming vehicles close enough to be a hazard.

Frequently Asked Questions

Your Questions Answered

Quick answers to the most common questions about the Oregon DMV test

How many questions are on the Oregon DMV permit test, and what is the passing score?
The Oregon DMV written knowledge exam consists of 35 multiple-choice questions based directly on the official Oregon Driver Manual. You must answer at least 28 questions correctly to achieve an 80% passing score. You can miss up to 7 questions; missing 8 results in a fail. The test is administered on computer touchscreens at state DMV field offices.
What is the minimum age to get an Oregon instruction permit?
In Oregon, you can apply for an Instruction Permit at 15 years old (under ORS 807.280). Applicants under 18 must bring a parent or legal guardian to sign parental consent, pass a vision screening (minimum 20/40 acuity), provide proof of identity, and provide proofs of Oregon residency.
Who is legally qualified to supervise a permit driver in Oregon?
Under Oregon law, an instruction permit driver must be accompanied in the front passenger seat by a licensed driver who is at least 21 years old and has been licensed for at least 3 years. The permit is valid for 24 months.
How long must you hold an Oregon instruction permit before taking the drive test?
Oregon requires teen drivers to hold their instruction permit for at least 6 months (180 days) before scheduling their behind-the-wheel drive test for a Provisional Driver License at age 16.
How many supervised practice driving hours does Oregon require?
To qualify for a Provisional License, Oregon teens must either: 1) complete an ODOT-approved Driver Education course and log 50 hours of supervised driving practice, OR 2) log 100 hours of supervised practice if not completing driver education, certified by a parent or guardian.
What passenger and night curfew rules apply to Oregon Provisional License holders?
Under ORS 807.122, 16- and 17-year-old provisional drivers face strict rules during their first year:
  • First 6 Months: Prohibited from carrying any passenger under age 20 who is not an immediate family member.
  • Second 6 Months: May carry no more than THREE passengers under age 20 who are not immediate family.
  • Night Curfew (Full Year): Prohibited from driving between midnight (12:00 a.m.) and 5:00 a.m. (unless driving to/from work, school activities, or with an adult 25+).
  • Device Ban: Complete ban on using mobile electronic devices (including hands-free) for drivers under 18.
What is Oregon’s "Basic Rule" speed law?
Under ORS 811.100, Oregon’s Basic Rule states that you must drive at a speed that is reasonable and prudent for existing road, traffic, and weather conditions, regardless of the posted speed limit. Driving at the posted speed limit can still be considered illegal speeding if road conditions are hazardous due to rain, ice, fog, or heavy congestion.
What is Oregon’s strict pedestrian crosswalk safety law?
Under ORS 811.028, Oregon law considers every intersection a legal crosswalk, whether marked or unmarked. Motorists must stop and remain stopped for a pedestrian until the pedestrian has completely cleared the driver’s lane plus the entire adjacent lane. When turning at a traffic signal, drivers must wait until the pedestrian is 6 feet past the turning lane.
What are Oregon’s legal parking distance rules?
Under ORS 811.550, the Oregon Driver Manual specifies the following parking clearances:
  • Within 10 feet of a fire hydrant (Oregon requires 10 feet).
  • Within 20 feet of a crosswalk at an intersection.
  • Within 50 feet of a stop sign, yield sign, or traffic control signal.
  • Within 50 feet of the nearest rail of a railroad crossing.
  • Within 15 feet of a fire station driveway entrance (or 75 feet across the street).
  • When parallel parked, wheels must be within 12 inches of the roadside curb.
What are Oregon’s Absolute Zero Tolerance DUII laws for drivers under 21?
In Oregon, impaired driving is charged as Driving Under the Influence of Intoxicants (DUII). Under ORS 813.300, Oregon enforces an Absolute Zero Tolerance (0.00% BAC) standard for drivers under 21—any measurable trace of alcohol or drugs results in an immediate 1-year license suspension. The legal limit for adults 21+ is 0.08%. Under Implied Consent, refusing a chemical breath/blood/urine test triggers a mandatory 1-year license suspension.
