Topic 01

Right-of-Way & Intersections

Exam Difficulty:Medium

Understanding who has the right-of-way is one of the most heavily tested areas on the Delaware DMV exam. Most failures occur here.

Must-Know DE Tip: Mountain Road Yield Rule

When two vehicles meet on a steep single-lane mountain road where they cannot pass, the vehicle facing downhill must yield by backing up until the vehicle going uphill can pass safely.

Core Rules & Tested Concepts

  • At intersections without signs, yield to the vehicle on your right if it arrives at the same time.
  • At T-intersections, vehicles on the terminating road must yield to vehicles on the through road.
  • When making a left turn, you must yield to oncoming vehicles close enough to be a hazard.

Quick answers to the most common questions about the Delaware DMV test

How many questions are on the Delaware DMV permit test, and what is the passing score?
The Delaware Division of Motor Vehicles (DMV) written knowledge exam consists of 30 multiple-choice questions based directly on the official Delaware Driver Manual. You must answer at least 24 questions correctly to achieve an 80% passing score. You can miss up to 6 questions; missing 7 results in a fail. The test is administered on computer touchscreens at Delaware DMV locations in New Castle, Wilmington, Dover, and Georgetown.
What is the Level 1 Learner’s Permit and who is eligible in Delaware?
Under 21 Del. C. § 2710, Delaware teens can apply for a Level 1 Learner’s Permit at 16 years old (or younger than 18) after completing a state-approved Driver Education course (30 classroom hours and 14 in-car hours: 7 driving + 7 observation) and receiving the official Delaware Driver Education Certificate (Blue/White Certificate), accompanied by parental consent.
Who is legally qualified to supervise a Level 1 permit driver in Delaware?
Under Delaware law, the supervising driver must be: 1) a licensed parent or legal guardian, or 2) a licensed driver who is at least 25 years old and has held a Class D driver’s license for at least 5 consecutive years. The supervisor must sit in the front passenger seat next to the driver whenever the vehicle is in motion.
What are the rules for the first 6 months of a Delaware Level 1 Permit?
For the first 6 months of holding a Level 1 permit, the teen must always drive with a qualified supervising adult in the front seat. The driver must complete and log at least 50 hours of supervised driving practice (including at least 10 hours at night) certified by a parent or guardian. No other passengers are allowed except the supervisor and one immediate family member.
What are the unsupervised driving rules for months 7 through 12 in Delaware?
During the second 6 months (months 7–12), if the 50-hour driving log is completed, the teen is permitted to drive unsupervised between 6:00 a.m. and 10:00 p.m. Between 10:00 p.m. and 6:00 a.m. (night curfew), the teen must be accompanied by a licensed supervisor (except when traveling directly to/from work, church, or school activities). Additionally, only ONE non-family passenger is allowed.
What are the penalties for teen drivers using cell phones in Delaware?
Under 21 Del. C. § 4176C, Level 1 permit holders are strictly prohibited from using any cell phone or electronic communication device while driving—including hands-free systems, speakerphones, and Bluetooth accessories. A first offense triggers an automatic 2-month (60-day) license suspension and a $100 fine.
What are the default statutory speed limits in Delaware when unposted?
Unless posted otherwise, statutory speed limits under 21 Del. C. § 4169 are:
  • School Zones: 20 mph.
  • Residential Districts: 25 mph.
  • Business Districts: 25 mph.
  • Two-Lane Undivided Rural Highways: 50 mph.
  • Four-Lane Divided Highways: 55 mph.
  • Limited-Access Freeways & Expressways (Route 1 / I-95): 65 mph.
What are the legal parking distance rules in Delaware?
Under 21 Del. C. § 4179, the Delaware Driver Manual specifies the following parking clearances:
  • Within 15 feet of a fire hydrant.
  • Within 20 feet of a crosswalk at an intersection.
  • Within 30 feet of a stop sign, yield sign, or traffic control signal.
  • Within 50 feet of the nearest rail of a railroad crossing.
  • Within 20 feet of a fire station driveway entrance (or 75 feet on the opposite side of the street).
  • When parallel parked, wheels must be within 12 inches of the roadside curb.
When must Delaware drivers stop for a school bus with flashing red lights?
Under 21 Del. C. § 4166, drivers approaching from any direction must stop at least 10 feet before reaching a school bus displaying flashing red lights and stop arm. On divided highways with four or more lanes separated by a physical median, opposing traffic is not required to stop. Illegally passing a school bus carries a minimum $115 fine and 1-month license suspension for a first offense.
What are Delaware’s Zero Tolerance underage drinking laws and adult DUI limits?
Under Delaware law (21 Del. C. § 4177 & § 2742), the legal Blood Alcohol Content (BAC) limits are: 0.08% for drivers 21+, 0.04% for commercial CDL drivers, and 0.02% (Zero Tolerance) for drivers under 21.
